How to report copyright infringement on material we host, how account holders can respond, and how we handle repeat infringement.

Overview

We respect intellectual property and expect the businesses that use our Service to do the same. This Policy explains how to report material hosted through the Service that you believe infringes your copyright, and how the account holder can respond.

We respond to notices that satisfy the Digital Millennium Copyright Act, 17 U.S.C. § 512. This Policy is part of our Terms of Service and works alongside our Acceptable Use Policy.

Where to send a notice

Send copyright notices and counter-notices to the copyright contact listed on this page, by email or by mail to the address shown there. Notices sent through support tickets, social media, or contact forms may be delayed or missed, so please use the listed contact.

How to file an infringement notice

To be effective under the DMCA, your written notice must include all of the following:

  • your physical or electronic signature, as the copyright owner or a person authorized to act for the owner;
  • identification of the copyrighted work you claim has been infringed, or a representative list if the notice covers multiple works;
  • identification of the material you claim is infringing, with enough detail for us to locate it, including the full URL of each page or file;
  • your name, mailing address, telephone number, and email address;
  • a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and
  • a statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on the owner’s behalf.

We may ask you for more information. A notice that is incomplete or that does not identify specific material may not be actionable, and we may decline to act on it until it is corrected.

What happens after we receive a notice

When we receive a notice that substantially satisfies the requirements above, we act expeditiously to remove or disable access to the identified material. Depending on the situation, that may mean unpublishing a page, removing a file, or restricting a site.

We notify the affected account holder, give them a copy of the notice, and tell them how to submit a counter-notice. We keep records of notices and of the action we took.

We may also remove or restrict material under the Terms of Service or Acceptable Use Policy when a violation is clear, even if a notice does not satisfy every statutory formality.

Counter-notices

If your material was removed and you believe that was a mistake or a misidentification, you may send a counter-notice containing all of the following:

  • your physical or electronic signature;
  • identification of the material that was removed and the location where it appeared before removal;
  • a statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification;
  • your name, mailing address, and telephone number; and
  • a statement that you consent to the jurisdiction of the federal district court for the judicial district of your address, or, if your address is outside the United States, of any judicial district in which the Company may be found, and that you will accept service of process from the person who filed the notice or from that person’s agent.

We will forward a valid counter-notice to the person who filed the original notice. Unless they tell us they have filed a court action seeking to restrain the activity, we may restore the material in 10 to 14 business days after we receive the counter-notice.

Repeat infringement

We keep a record of copyright notices we receive and, in appropriate circumstances, we terminate the accounts of customers who repeatedly infringe. In deciding what is appropriate we consider the number and credibility of notices, whether counter-notices were filed, whether the conduct appears deliberate, and the customer’s response.

Customers are responsible for the content on their sites, including content added by their team members or contractors.

Misrepresentation

Under 17 U.S.C. § 512(f), a person who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages, costs, and attorneys’ fees. Do not submit a notice or counter-notice as a way to resolve a business dispute, remove criticism, or gain leverage.

We may provide a copy of a notice or counter-notice, including the contact information it contains, to the other party, and we may publish or submit notices to a transparency database with personal contact details withheld where practical.

Trademark and other complaints

The DMCA process covers copyright only. Report trademark concerns, impersonation, defamation, privacy violations, counterfeit goods, and other issues through our Report Abuse page or to the legal contact listed on this page, with the URL and an explanation of your rights and the problem.

Your responsibilities as a customer

Publish only material you own or are licensed to use, and keep records of your licenses, including for stock images, fonts, video, music, and code. Respond promptly if we forward a notice to you, and keep your account contact information current so we can reach you.
